Terms of Service
Effective October 15, 2026 · Goins Logistics LLC d/b/a Fleet Retrieval
Please read these Terms carefully. They explain what Fleet Retrieval does, what we need from you, and how responsibility is shared when a commercial asset is retrieved and relocated.
01Agreement & Eligibility
These Terms of Service ("Terms") govern your use of this website and any request for services submitted to Fleet Retrieval, operated by Goins Logistics LLC ("Fleet Retrieval," "we," "us"). By submitting a request, application, or form, you agree to these Terms.
Our services are offered to businesses and commercial fleet operators. If you submit a request on behalf of a company, you represent that you have authority to bind that company.
02Scope of Operations
Fleet Retrieval provides commercial fleet asset retrieval and relocation, including driver-abandonment recovery, urgent load recovery and rescue, fleet equipment repositioning, medical and compliance retrieval, and repair-shop-to-yard shuttles.
Fleet Retrieval is not a repossession company. We do not perform repossession, lien enforcement, or any self-help remedy, and we do not take possession of any asset over the objection of a person with a lawful right to possess it.
- We may decline, pause, or cancel any request where lawful authority is unclear, the asset is subject to a dispute, a breach of the peace is possible, or the safety of our personnel is at risk.
- A quote or estimate is not a guarantee of service until we confirm acceptance and scheduling.
03Authorization & Representations
By requesting service, the client represents and warrants that:
- It is the legal owner of the asset, or has express written authority from the owner (or lawful custodian) to have the asset retrieved, moved, and delivered.
- The asset is not being retrieved in connection with a repossession, a lien dispute, or any proceeding in which another party has a competing right to possession.
- All information supplied — including asset location, unit identifiers, key and access details, equipment condition, and destination — is accurate and complete to the best of its knowledge.
- It will promptly notify us of any change in authority, location, or condition before or during the retrieval.
04Quotes, Scheduling & Payment
We aim to respond to fast-track requests with a quote within sixty (60) minutes during operating hours and on our emergency line. This is a target, not a guarantee.
Pricing, included travel logistics, and payment terms are stated in the written quote or service agreement for each assignment. Work begins once the client approves the quote. Changes in scope, delays caused by the client or by site access, and additional services are billed as agreed in writing.
05Pre-Roll Inspection & Existing Damage
Before an asset is moved, our driver performs a 50-point inspection and photo documentation at pickup, and delivers a condition report at delivery.
Conditions, damage, wear, and defects documented at pickup are treated as pre-existing, and Fleet Retrieval is not responsible for them. Fleet Retrieval is responsible only for physical damage to the asset that occurs while in our custody and that is not documented in the pre-roll inspection, subject to the limitations in these Terms.
Any claim must be submitted in writing, with supporting photos, within seventy-two (72) hours of delivery. The client remains responsible for maintaining its own physical damage, liability, and cargo insurance on the asset and any cargo unless otherwise agreed in writing.
06Fuel, Tolls & Mechanical Failures
Fuel, tolls, and travel costs are handled as stated in the quote. Where the client supplies a fuel card or express code, it will be used only for fuel for the assigned move. Where no card is supplied, fuel is billed to the recovery invoice.
The client is responsible for pre-existing mechanical conditions and for costs that arise from them, including:
- Towing, roadside service, jump starts, on-site fueling, locksmith services, and key replacement.
- Repairs required to make the unit safe or legally operable.
- Delays, storage, or re-dispatch resulting from a unit that is not road-worthy or not DOT-compliant.
07Compliance & Right to Refuse
Every recovery is performed with regulatory compliance as the baseline. We will not operate an asset that, in our reasonable judgment, is unsafe, out of compliance, or not legally able to be operated. In that case we may stop the move and arrange alternative transport, such as towing, at the client's expense.
08Cargo & Load Recovery
Unless a written agreement says otherwise, we are not responsible for the condition, value, or loss of cargo, or for delay-related penalties imposed by the client's customers. Load rescue assignments are performed under the terms of the specific quote.
09Driver Standby Network Applications
Submitting a driver application does not create an employment relationship and does not guarantee work. Opportunities are offered on an independent contractor basis, on demand, with the right to accept or refuse any assignment, and are governed by a separate written agreement. Applicants may be asked to complete driving record, background, and credential screening, which will be conducted only with the applicant's separate authorization where required by law.
Applicants represent that the information they submit is true and complete. Material misstatements may result in removal from consideration.
10Limitation of Liability
To the fullest extent permitted by law, Fleet Retrieval will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, or loss of business, arising from the services or this website.
To the fullest extent permitted by law, our total liability for any claim relating to a specific assignment is limited to the fees paid to us for that assignment.
11Indemnification
The client will defend, indemnify, and hold harmless Goins Logistics LLC and its personnel from third-party claims, losses, and expenses (including reasonable attorneys' fees) arising from the client's breach of the representations in these Terms, including any claim that the client lacked ownership or authority over the asset.
12Governing Law & Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Durham County, North Carolina, and the parties consent to that jurisdiction.
13Changes & Contact
We may update these Terms from time to time. The effective date above shows when they were last revised. Continued use of the site or services after an update means you accept the revised Terms.
